Short answer
Because Ontario’s matrimonial-home rules can give a spouse possession rights even when that spouse is not a registered owner. A disposition or encumbrance may require the spouse’s consent, a court order or another legally acceptable basis. Your lawyer—not the mortgage broker—must determine what applies.
Why this becomes a closing problem
The borrower qualifies alone and assumes the spouse is irrelevant because the title is in one name. During legal closing, the lawyer identifies the property as a matrimonial home and requires consent that was never discussed.
A practical Ontario example
One spouse owned the home before marriage and remains the only registered owner. The couple now lives there as its family residence. A refinance is not simply an income calculation; family-law and title requirements may still affect whether the new charge can register.
How the lending routes may differ
- A lender: requires the lawyer to satisfy matrimonial-home and title conditions before registration.
- Alternative/B lender: broader income policy does not remove a spouse’s legal rights or required consent.
- MIC/private lender: speed and equity-based underwriting do not override Ontario family-law requirements.
Important boundary: Ontario legislation and legal-registration requirements are not lender underwriting policies. Each lender decides its acceptable borrower, property, priority and documentation requirements, while the closing lawyer determines the legal work needed.
Questions to ask now
- Is this or was this the family residence?
- Who is legally married, separated or occupying the home?
- Does the lawyer require consent or independent legal advice?
- Do separation terms match the proposed mortgage and title?

Disclose marital status and occupancy accurately at the beginning. A spouse who is not helping with income can still be essential to the legal completion of the mortgage.
