How do I verify an Ontario new-home builder before signing?

Search the HCRA Ontario Builder Directory before signing. It can show licensing status, experience, homes built and regulatory history, including project information and certain cancellations.

Is GST/HST charged when a new-construction purchase agreement is assigned?

Generally, yes. CRA says all assignment sales of newly constructed or substantially renovated residential housing are taxable for GST/HST purposes when the agreement is entered into after May 6, 2022.

Is the pre-delivery inspection form also a Tarion warranty claim?

No. The PDI documents missing, damaged or incomplete items before possession, but Tarion says the PDI form itself is not a warranty claim. Unresolved items may need to be submitted separately through the applicable warranty form.

Why isn’t interim occupancy the same as owning and closing a condo?

During interim occupancy, the buyer may live in the unit but does not yet own it because the condominium has not registered. The buyer pays the developer an occupancy fee rather than regular mortgage payments.

When can an Ontario new-home buyer claim delayed closing or occupancy compensation?

Tarion may compensate eligible buyers when the builder fails to give required delay notice or misses protected dates. The claim is not automatic, and Tarion says the form generally must be submitted within one year after possession or occupancy.

Does Tarion guarantee the return of every builder deposit?

No. Tarion deposit protection applies only in specified circumstances and up to applicable limits. It should never be described as unlimited insurance for every deposit, upgrade payment or contract dispute.

Must a new freehold buyer register the purchase with Tarion within 45 days?

Yes. Tarion says new freehold purchasers must notify it within 45 days of signing beginning April 1, 2026. Tarion also says the reduced-coverage consequence for late registration is deferred during a transition until January 1, 2027.

Is Ontario introducing a 10-day cooling-off period for new freehold homes?

Yes. Tarion reports that Ontario regulatory changes coming into force January 1, 2027 will support a 10-day cooling-off period and new information sheets for buyers of new freehold homes.

Can a material change to a condo disclosure statement create another cancellation right?

Potentially. Ontario condo law can provide an additional 10-day rescission period after a material change to the disclosure statement, but whether a change is legally “material” can require professional advice.

When does Ontario’s 10-day pre-construction condo cooling-off period begin?

The 10-calendar-day period generally begins only after the buyer has received the signed purchase agreement, disclosure statement and Ontario Condo Buyers’ Guide. Signing alone may not be the only date that matters.
